Terms & Conditions

To Keep You Safe

By signing up for classes or programs with The Experience Studio Inc., you acknowledge and agree to the following:

  • Fitness classes and activities involve physical activity and carry risks, including injury, illness, muscle strain, falls, property damage, or, in rare cases, serious injury or death.

  • You participate voluntarily and accept these risks.

  • You should speak with a medical professional before participating if you are pregnant or have any injury, medical condition, or health concern.

  • You confirm that you are physically able to participate safely and will inform us of any changes to your health or physical condition.

  • You agree to use equipment safely and understand it is your responsibility to inspect any equipment before use.

  • You agree to participate respectfully and safely to avoid harm to yourself or others.

 

Release of Liability

By participating in our classes, programs, workshops, online content, or events, you agree that The Experience Studio Inc., including its owners, staff, instructors, contractors, and affiliates, will not be held responsible for any injury, illness, loss, damage, or expenses that may occur as a result of participation, including those caused by negligence.

You also agree not to make legal claims against the studio related to your participation.

Minors

Participants under 18 must have a parent or legal guardian accept these terms on their behalf.

 

Ongoing Agreement

This agreement applies to all future participation in classes and programs unless updated by the studio.

Manitoba Law

This agreement is governed by the laws of Manitoba, Canada, and any legal matters must be handled within Manitoba.

 

Confirmation

By accepting the Terms & Conditions during sign-up, you confirm that:

  • -You have read and understood this agreement

  • -You accept the terms voluntarily 

  • -You understand you are giving up certain legal rights, including the right to sue

  • You understand you are giving up certain legal rights, including the right to sue

Terms of Service, Studio Policies & Privacy Policy

The Experience Studio

By purchasing a membership, class pack, or drop-in class, attending classes, or creating an account with The Experience Studio, you acknowledge that you have read, understood, and agree to the following Terms of Service, Studio Policies, and Privacy Policy.

Payments & Membership Policies

All memberships, class packs, and drop-in classes are non-transferable and non-refundable unless otherwise required by law.

Payments are processed automatically according to the membership or package selected at checkout.

A valid payment method must remain on file for all active memberships.

Failed or declined payments may result in suspension of studio access until the account balance is resolved.

Drop-in classes must be paid in full at the time of booking.

Prices for memberships, class packs, or drop-in classes may change at any time. Existing memberships will receive notice prior to any pricing adjustments when applicable.

Class Reservations

Clients are encouraged to reserve their spot in advance through the studio’s booking system.

Drop-in clients must also reserve a spot prior to attending class.

Class spots are limited and may fill quickly.

The Experience Studio reserves the right to cancel or modify class schedules when necessary.

Cancellations & Late Policies

Class cancellations must be made at least 4 hours prior to the scheduled class time to avoid penalty.

Late cancellations or no-shows may result in:

  • Loss of a class credit

  • A late cancellation fee for membership holders

Drop-in classes that are cancelled within the 4-hour window are non-refundable.

Membership Cancellations

Membership cancellations require written notice at least 30 days prior to the next billing cycle.

Memberships will remain active during the 30-day notice period.

Memberships cannot be paused during the cancellation notice period. 

Memberships cancelled before the completion of the 6-month term will be subject to an early cancellation fee equal to 70% of the remaining balance owed on the membership agreement. Payment of this amount is required upon cancellation.

Membership Freezes

Membership freezes may be granted for medical or travel reasons at the discretion of The Experience Studio.

Freeze requests must be submitted in writing and approved by studio management.

Additional terms or limits may apply depending on the membership type.

Studio Etiquette

To ensure a positive and respectful environment for all clients:

  • Please arrive on time for class

  • Late arrivals may not be admitted once class has started

  • Mobile phones should be silenced during class

  • Respect the studio space, equipment, instructors, and other clients

Media Release

Photos or videos may occasionally be taken during classes or studio events for promotional purposes including social media, marketing materials, and the studio website.

By attending classes or events, you grant The Experience Studio permission to use photos or videos taken on the premises.

If you do not wish to appear in photos or videos, please notify the studio in writing and we will make reasonable efforts to accommodate your request.

Right to Refuse Service

The Experience Studio reserves the right, at its sole discretion, to refuse service, membership, or participation in any class or program to any individual if their conduct, behavior, or presence is deemed disruptive, unsafe, inappropriate, or not aligned with our community standards.

This includes, but is not limited to, actions that negatively impact the comfort, safety, or well-being of clients or staff.

In such cases, The Experience Studio may cancel or revoke memberships or class credits and issue refunds when appropriate.

Privacy Policy

The Experience Studio is committed to protecting the privacy of our clients.

We may collect personal information necessary to provide services, including:

  • Name

  • Email address

  • Phone number

  • Booking and attendance history

  • Payment details (processed through secure third-party payment providers)

  • Health information submitted through waivers or PAR-Q forms

  • Emergency contact information

This information is used for purposes including:

  • Managing your account and bookings

  • Processing payments

  • Communicating studio updates

  • Ensuring client safety during classes

  • Meeting legal and regulatory obligations

Payment information is processed securely through third-party payment providers. The Experience Studio does not store full credit card numbers.

Client information is stored securely and only retained for as long as necessary to provide services or comply with legal obligations.

The Experience Studio does not sell or share personal information with third parties for marketing purposes.

Clients may request access to or correction of their personal information by contacting the studio.

Governing Law

These Terms of Service and Privacy Policy shall be governed by and interpreted in accordance with the laws of Manitoba, Canada.

Acknowledgment & Acceptance

By purchasing a membership, class pack, or drop-in class, or by attending classes at The Experience Studio, you confirm that you have read, understood, and agree to these Terms of Service, Studio Policies, and Privacy Policy.

SMS Communications & Consent
By providing your mobile phone number, you consent to receive SMS (text) messages from us related to your membership, bookings, reminders, promotions, and important updates. Message frequency may vary. Standard message and data rates may apply. 

SMS and Mobile Information
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
